    11B-35.002:Basic Recruit Training Programs for Law Enforcement, Correctional, and Correctional Probation

    NOTICE IS HEREBY GIVEN that on July 10, 2015, the Criminal Justice Standards And Training Commission received a petition for a permanent waiver of paragraph 11B-35.002(2)(a), F.A.C., from Chief Van Toth, Hialeah Gardens Police Department, on behalf of Wisner Dorismond. The Petitioner wishes to permanently waive that portion of the rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination (SOCE) pursuant to Rule 11B-30.0062, F.A.C., and gain employment and certification as an office. Petitioner states that Mr. Dorismond is presently employed as a Miami-Dade County Correctional Officer and has conducted the self-sponsored cross over training specified in Section 943.13, F.S. Petitioner states that Mr. Dorismond applied with the Hialeah Gardens Police Department for a part-time police officer on March 15, 2015. Petitioner states that because of an oversight on the part of the Hialeah Gardens Police Department, Mr. Dorismond was hired as a part-time officer on July 7, 2015 however, pursuant to paragraph 11B-35.002(2)(a), F.A.C., his four-year grace period ran out on May 27, 2015.

    Petitioner states that Hialeah Gardens Police Department is in need of Mr. Dorismond as a certified officer and that due to budget constraints and staffing resources, the City is unable to sponsor Mr. Dorismond through an academy. Petitioner states that Mr. Dorismond has started field training and he is needed to augment the City’s patrol division. Petitioner states that the purpose of the underlying statute would be satisfied if the waiver is granted and that strict application of the rule would result in unreasonable, unfair and unintended results in this instance.
