The Board of Nursing hereby gives notice that on May 9, 2016, a Notice of Intent to Dismiss Petition for Waiver and Variance was filed. The Petition for Waiver or Variance was filed by Heart To Heart Health Academy, on March 21, 2016, seeking a waiver or variance from Chapter 28-104, F.A.C., with regard to not having any test takers for one calendar year. The Notice was published in Volume 42, No. 56, of the Florida Administrative Register on March 22, 2016. The Board, at its meeting held on April 6-8, 2016, voted to dismiss the Petition for Waiver or Variance finding that the rule cited by Petitioner does not fall within the jurisdiction of the Board of Nursing.
