    61H1-33.006Inactive or Delinquent Florida Certified Public Accountants Who Desire to Become Active Licensees

    The Board of Accountancy hereby gives notice of the issuance of an Order regarding the Petition for Waiver or Variance, filed on May 5, 2017, by Cristina Martell. The Notice of Petition for Waiver or Variance was published May 16, 2017 in Vol. 43, No. 95 of the, Florida Administrative Register. Petitioner sought a waiver or variance of paragraph 61H1-33.006(2)(c), Florida Administrative Code, entitled “Inactive or Delinquent Florida Certified Public Accountants Who Desire to Become Active Licensees,” that requires for each Florida certified public accountant, who became delinquent and desires to return his/her license to active status, shall satisfy the requirements of his/her most recent biennium plus 200 additional CPE hours in the following manner: at least 40 hours of Accounting/Auditing, at least 4 hours in Ethics, no more than 20 hours in behavioral, for a total of 280 hours. The Board considered the instant Petition at a duly-noticed public meeting, held June 2, 2017, in Orlando, Florida.

    The Board’s Order, filed on June 29, 2017, denied the petition finding that Petitioner failed to establish that the purpose of the underlying statute would be met by granting a variance from paragraph 61H1-33.006(2)(c), F.A.C. The Board further found that Petitioner failed to establish that applying the requirements of the aforementioned rule to her circumstances would violate principles of fairness and impose substantial hardship.
