The Board of Clinical Laboratory Personnel hereby gives notice of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on April 13, 2017, by Darlene Keppel. The Notice of Petition for Waiver or Variance was published April 21, 2017 in Volume 43, Number 78, of the Florida Administrative Register. The Petitioner was seeking a waiver or variance of subsection 64B3-11.001(1), Florida Administrative Code, entitled “Continuing Education,” which requires that in order to renew a clinical laboratory personnel license, a minimum of 24 contact hours of continuing education shall be earned during each biennium including a minimum of one contact hour for each of the categories in which the individual is licensed. The Board considered the instant Petition at a duly-noticed public telephonic meeting held June 2, 2017.

The Board’s Order, filed on June 20, 2017, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from subsection 64B3-11.001(1) Option 1, F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to her circumstances would violate principles of fairness and impose substantial hardship.
