NOTICE IS HEREBY GIVEN that the Division of Professions, Department of Business and Professional Regulation, State of Florida, on July 19, 2013, has issued an order disposing of the petition for declaratory statement filed by Don Meyler Inspections, Inc. on May 10, 2013. The following is a summary of the agency's disposition of the petition:

A licensed home inspector or licensed contractor would not violate the provisions of Section 468.8319, F.S. by offering a fee to insurers for referral of wind mitigation clients; the phrase “broker or agent therfor,” used in subsection 468.8319 (1)(h), F.S. does not apply to insurance agents and does not prohibit an inspector from offering the insurance agent a referral fee; and advertisements of the proposed incentive/ referral fee program are not prohibited by Ch. 468, Part XV, Florida Statutes.
