NOTICE IS HEREBY GIVEN that on July 18, 2016, the Department of Health, received a petition for Permanent Variance from Rule 64E-11.004, F.A.C., from The School District of Lee County, Food and Nutrition Services, 2855 Colonial Blvd., Fort Myers, Florida 33966. The petitioner requests to use “Time Alone as a Public Health control to Limit Bacteria Growth in Potentially Hazardous Foods” and cites Rule 64E-11.004, F.A.C., as “Perishable food shall be stored at such temperatures as will protect against spoilage. All potentially hazardous food shall be kept at safe temperatures, 41°F or below and 140°F or above, except during necessary periods of preparation and service.” Comments on this petition should be filed with Shannon Revels, Agency Clerk, Department of Health, Office of General Counsel, 4052 Bald Cypress Way, BIN A08, Tallahassee, Florida 32399-1710, within 14 days of this notice.
