NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by James M. Sapp/MESA on July 22, 2015. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Volume 41, No. 78, of the April 22, 2015, Florida Administrative Register. The Petitioner asks the Board, which license, General Contractor, Natural Gas Contractor or Underground Utility and Excavation Contractor, would be required to perform the excavation of pipelines and associated trenching activities, and whether an Underground Contractor’s license is limited to work on water, sewer, and storm drain lines. The Board’s Order, filed on June 25, 2015, declines to issue a declaratory statement because the Petition does not state with particularity the Petitioner’s set of circumstances as required by Section 120.565(2), Florida Statutes.
