    61C-5.001Safety Standards

    The Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety hereby gives notice:

    On July 21, 2020 the Division issued an order. The Final Order was in response to a Petition for a permanent Variance from Centro Asturiano de Tampa at 1913 N. Nebraska Ave, Tampa, FL filed May 20, 2020, and advertised on May 28, 2020 in Vol. 46, No. 104, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance denies the Petitioner a variance from Rules 2.1.3.5, 2.6.6.3, 2.10.1, 2.10.10, 2.11.1, ASME A18.1, 2008 edition, as adopted by Rule 61C-5.001 Florida Administrative Code and NEC 620.SI(A) and Florida Building Code, Accessibility 2017, 410.1, 410.3, 410.6, 404 that require the lower landing side of the platform needs an automatic arm or door, the platform needs a handrail on the side wall, a battery backed emergency light on the platform, operation station at first landing, a means of manual operation, a battery backed alarm button, an externally lockable disconnect for the platform lift, clear floor space on the platform needs to be 30" by 48" minimum a. Front entrance needs to be at least 32” wide and the side entrance needs to be 42” wide, doors and gates be automatic, and clearances at the top landing because the Petitioner has not demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW 2020-071).
