    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

     

    60FF1-5.010 Fee Allocation.

    The E911 Board adjusts the wireless fee allocation as follows: 

    (1) Seventy-six percent of the money in the wireless category shall be distributed each month to counties, except that from August 1, 2021 to December 31, 2026 January 1, 2019 to December 31, 2022, ninety-four and ¾ (94.75%) eighty-eight percent of the money in the wireless category shall be distributed each month to counties.

    (2) Twenty percent of the money in the wireless category shall be distributed to wireless providers in response to sworn invoices submitted to the board by wireless providers to reimburse such wireless providers for the actual cost incurred to provided 911 or E911 service, except that from August 1, 2021 to December 31, 2026, January 1, 2019 to December 31, 2022, ¼ (.25%) eight percent of the money in the wireless category shall be distributed to wireless providers in response to sworn invoices submitted to the board by wireless providers to reimburse such wireless providers for the actual costs incurred to provided 911 or E911 service.

    (3) Three percent of the money in the wireless category shall be used to make distribution to rural counties, except that from August 1, 2021 to December 31, 2026, four percent of the money in the wireless category shall be used to make distribution to rural counties. 

    (4) No change.
