    Right-of-Way Use Permit Ordinance

    The Seminole County Planning and Zoning Commission will hold a Public Hearing on Wednesday, August 5, 2020, at 6:00 PM where it may make a recommendation to the Seminole County Board of County Commissioners for approval or disapproval. The Seminole County Board of County Commissioners will then hold a Public Hearing on Tuesday, August 25, 2020 at 1:30 PM. Both Public Hearings will be held in the County Services Building, 1101 East First Street, Sanford, Florida, Room 1028 (Board Chambers) to consider:

    AN ORDINANCE AMENDING CHAPTER 2 (DEFINITIONS) OF THE LAND DEVELOPMENT CODE OF SEMINOLE COUNTY, FLORIDA TO ADD DEFINITIONS FOR “COLLOCATE” OR “COLLOCATION”, “UTILITY POLE”, “SMALL WIRELESS FACILITIES”, AND “WIRELESS FACILITY”; AMENDING SECTION 35.95 (UTILITY LINES) OF THE LAND DEVELOPMENT CODE OF SEMINOLE COUNTY, FLORIDA TO ADD A REFERENCE TO PROVISIONS IN SECTION 75.14 (SMALL WIRELESS FACILITIES IN RIGHT-OF-WAY) AND MAKING OTHER CHANGES; AMENDING CHAPTER 75 (RIGHT-OF-WAY USE PERMITTING) OF THE LAND DEVELOPMENT CODE OF SEMINOLE COUNTY, FLORIDA; CLARIFYING THE PURPOSE AND INTENT OF THIS CHAPTER; CLARIFYING HOW THIS CHAPTER APPLIES TO WORK PERFORMED IN THE COUNTY RIGHT-OF-WAY AND TO SAFE INGRESS AND EGRESS ACCESS TO THE COUNTY RIGHT-OF-WAY; UPDATING THE CHAPTER’S PROVISIONS RELATING TO FEDERAL STANDARDS FOR MAILBOXES; UPDATING INSURANCE AND OTHER REQUIREMENTS; CLARIFYING THAT TIME LIMITS ON RIGHT-OF-WAY PERMITS APPLY TO THE PERFORMANCE OF WORK IN THE RIGHT-OF-WAY AND NOT TO INGRESS AND EGRESS RIGHTS OR COMPLETED INSTALLATIONS; ADDING NEW SECTIONS FOR CONSTRUCTION BONDS AND ABANDONED FACILITIES; ADDING A NEW SECTION TO PROVIDE FOR THE BOARD OF COUNTY COMMISSIONERS TO GRANT WAIVERS TO THE PROVISIONS OF THIS CHAPTER; PROVIDING FOR OTHER CLARIFICATIONS; ADDING A NEW SECTION TO PROVIDE FOR SMALL WIRELESS FACILITIES IN COUNTY RIGHT-OF-WAY; PROVIDING FOR CODIFICATION IN THE LAND DEVELOPMENT CODE OF SEMINOLE COUNTY, FLORIDA; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

    All interested persons are encouraged to appear at this hearing and present input regarding the proposed item in accordance with the procedures used by the Commission, or submit written comments to wwharton@seminolecountyfl.gov, at the Seminole County Planning and Development Division Office at the address above, Room 2028, or telephone Bill Wharton at 407-665-5730; FAX 407-665-5772. In light of the current situation surrounding the COVID-19 virus, telephone and communications media technology for public participation may be utilized for this meeting if deemed necessary. Interested persons should call the above phone number for more details as the meeting date approaches. Input received in a timely manner will be forwarded to both the Planning and Zoning Commission and the Board of County Commissioners for consideration at the public hearing. Additional information regarding this item, and any comments received, are available for public review at the address above, Room 2028, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, excluding holidays. Both Commissions may continue hearings from time-to-time as found necessary. Persons are advised that if they decide to appeal any decisions made at this hearing, they will need a record of the proceedings, and for such purpose they may need to ensure a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based (Florida Statutes, Section 286.0105).
