    68A-17.004General Regulations Relating to Wildlife and Environmental Areas

    PURPOSE AND EFFECT: The purpose of the proposed rule amendment is to establish or revise general regulations related to Wildlife and Environmental Areas (WEAs). The effect of the proposed rule amendment will be to enable the agency to better manage fish and wildlife resources and public use on WEAs.

    SUMMARY: Following recent changes to Section 316.003, F.S., the proposed rule amendment would maintain the status quo regarding electric bicycle use on WMAs such that electric bicycles may only be operated on named or numbered roads except Class 1 electric bicycles are exempt from this restriction and may be operated anywhere non-motorized bicycles may be used unless otherwise prohibited by specific area rule.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The nature of the rule and the preliminary analysis conducted to determine whether a SERC was required

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    (a) through (c) No change

    (d) Electric bicycles may be operated only on named or numbered roads. Unless otherwise prohibited by specific area rule, Class 1 electric bicycles (as defined in 316.003, F.S.) are exempt from this restriction and may be used pursuant to regulations relating to bicycles.

    (10) through (17) No change.

    PROPOSED EFFECTIVE DATE:  As soon as possible after approval by the Commission.
