Division of Florida Land Sales, Condominiums and Mobile HomesNOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Bruce L. Barlow, Richard F. Jones and David W. Redmond, Petitioners, In RE: Grand Panama Beach Resort Condominium Association, Inc., Docket No. 2008039695. The petition seeks the agency’s opinion as to the applicability of Chapter 718, Florida Statutes, as it applies to the petitioner.
Whether BNP Investment Properties, LLC may substitute a letter of credit for a buyer’s earnest money deposit under Section 718.202(1)(d), Florida Statutes, after the buyer has notified it and the escrow agent that the funds were in dispute.
