The Board of Osteopathic Medicine hereby gives notice:

that on June 11, 2018, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed by Kenneth S. Conte, D.O., on March 30, 2018, seeking a waiver or variance from Rule 64B15-13.003, F.A.C., with regard to proof of completion of continuing medical education hours. The Notice was published in Volume 44, No. 66, of the Florida Administrative Register, on April 4, 2018. The Board, at its meeting held on May 18, 2018, voted to deny the Petition for Waiver finding that the Petition was not in substantial compliance with the provisions of Section 120.542, F.S.; that Petitioner failed to demonstrate a substantial hardship; that Petitioner failed to demonstrate that application of the rule would violate the principles of fairness; and failed to demonstrate that the purpose of the underlying statute has been met.
