62-602.270Eligibility for Operator Examinations
The Department of Environmental Protection hereby gives notice that it has issued an order on July 15, 2016 granting the School Board of St. Johns County, Florida’s Petition for Variance. The Petition was received on March 14, 2016. Notice of receipt of this Petition was published in the Florida Administrative Register on March 17, 2016, Vol 42, No. 53. The petition requested a variance from paragraph 62-602.270(1)(a), F.A.C, to allow students enrolled in the Academy of Coastal and Water Resources at the St. Johns Technical High School to take the Level C Water/Wastewater Exam from the Operator Certification Program prior to high school graduation. No comments were received in response to the notice. The Order, OGC Case No. 16-0146, granted the Petition to paragraph 62-602.270(1)(a), F.A.C., based on a showing that Petitioner demonstrated that it will suffer a substantial hardship if students are precluded from taking the exam prior to obtaining the high school diploma; entry in the workforce upon graduation would be delayed and an economic hardship would occur if made to comply with the current examination requirements.
