    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 41 No. 144, July 27, 2015 issue of the Florida Administrative Register.

    Language has been added to the rule to provide for other qualified aliens as defined under federal law to be eligible to qualify as a Florida resident for tuition purposes.  In addition, the date of the Residency Declaration, which is incorporated into the rule by reference, was changed from August 28, 2014, to September 3, 2015.

    The Residency Declaration was revised to provide for other qualified aliens as defined under federal law to be eligible to qualify as a Florida resident for tuition purposes, and the date of the Residency Declaration was changed from August 28, 2014, to September 3, 2015. In addition, the language pertaining to documentation showing proof of a permanent home in Florida occupied as a primary resident for 12 consecutive months prior to the student's enrollment was supplemented to allow for the person claiming residency to submit multiple leases reflecting a Florida address. The language pertaining to documentation of proof of permanent employment in Florida for at least 30 hours per week for a 12-month period was also supplemented to allow for the person claiming residency to submit an Internal Revenue Service 1099 with verification of employment for the past 12 consecutive month period from an employer. Finally, technical changes were made to the Residency Declaration to re-order the sections so that the ability to qualify as a Florida resident by virtue of the statutory provisions set forth in section 1009.21(10), Florida Statutes, would appear in the first part of the Residency Declaration, thereby making it easier for students who meet one of those provisions to complete the Declaration.
