NOTICE IS HEREBY GIVEN THAT the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Roger W. Feicht on February 22, 2016. The following is a summary of the agency’s disposition of the Petition: The Notice of Petition for Declaratory Statement was published in Volume 42, No. 44, of the March 4, 2016, Florida Administrative Register. The Petitioner seeks a declaratory statement as to the applicability of 455.227 and 489.129, F.S., as it applies to whether a reporting deadline would bar or otherwise limit a complaint based on conduct of a contractor which occurred during the years 2007, 2008 and 2009. The Construction Industry Licensing Board considered the Petition at its meeting held on April 15, 2016, in Jupiter, Florida. The Board’s Order, filed on July 6, 2016, declines to issue a declaratory statement in this matter because the petitioner is not a substantially affected party and does not have standing to request a declaratory statement, and because the petition does not relate to a particular set of circumstances.
