61G15-23.002Seal, Signature and Date Shall Be Affixed

The Board of Professional Engineers hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Allen Gezelman, P.E., filed on June 3, 2014. The Notice of Petition for Variance or Waiver was published in Vol. 40, No. 125, of the June 27, 2014, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting by held on June 12, 2014. The Petitioner was seeking the Variance or Waiver from Rule 61G15-23.002, F.A.C., with respect to the requirement a professional engineer shall sign by hand the licensee’s handwritten signature to all final drawing, specifications, plans, reports, or documents prepared or issued by the licensee and being filed for public record due to a medical condition.

The Board’s Order, filed on July 2, 2014, grants the Petition for Variance or Waiver. The Board found that the petition was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Based upon the documents presented and the testimony of the Petitioner, the Board found that the Petitioner will meet the purpose of the underlying statute and has otherwise shown that the application of the rule would violate the principles of fairness as applied to him based upon his disability. The Petitioner shall be permitted to use a signature stamp to sign documents that otherwise require a handwritten signature pursuant to subsection 61G15-23.002(1), F.A.C.
