NOTICE IS HEREBY GIVEN that The Department of Business and Professional Regulation, Division of Alcoholic Beverages and Tobacco has received the petition for declaratory statement from Nixon Peabody, LLP, DS 2015-087. The petition seeks the agency’s opinion as to the applicability of Section 561.42, F.S; and Chapter 61a-1.010, F.A.C., as it applies to the petitioner.

The Petitioner, Nixon Peabody, LLP, on behalf of their clients, Citibank, and an Australian Winery, want to ensure that their proposed business promotion will abide by the rules and qualifications set forth in Section 561.42, F.S; and Chapter 61a-1.010, F.A.C. During this promotion, customers that use their Citibank card for a minimum purchase in participating restaurants would receive discounts on future food purchases and a voucher for a bottle of wine, with the total discount and wine selections increasing with the amount of each purchase.
