    61J1-8.003Notice of Noncompliance

    The Florida Real Estate Appraisal Board hereby gives notice of the issuance of an Order regarding the Petition for Variance, filed on September 26, 2012, by William Terry Hanes. The Notice of Petition for Waiver or Variance was published in Vol. 38, No. 67, of the November 7, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on December 4, 2012. Petitioner was seeking that his violations of Subsections 475.624(15) and 475.629, Florida Statutes, as committed by Petitioner, and Rule 61J1-7.001, Florida Administrative Code, be reclassified as minor violations, thereby allowing them to be classified as inactive pursuant to Section 455.2255, Florida Statutes.

    The Board’s Order, filed on May 22, 2013, denies the petition finding that Petitioner has not demonstrated that the purpose of the statute would be met as required by subsection 455.225(3), Florida Statutes. Petitioner has failed to demonstrate that full application of subsection 61J1-8.003(1), Florida Administrative Code, to his circumstances would violate principles of fairness and would impose a substantial hardship on him.
