64B17-3.001Licensure as a Physical Therapist by Examination

The Board of Physical Therapy Practice hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Jonathan Bautista, filed on March 7, 2013. The Notice of Petition for Variance and Waiver was published in Volume 39, No. 52, of the March 15, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on May 3, 2013. The Petitioner was seeking a permanent variance or waiver of subsection 64B17-3.001(3), Florida Administrative Code, with regards to the requirement that an applicant demonstrate that he or she meets the requirements of Rule 64B17-3.001, Florida Administrative Code, and may be licensed to practice physical therapy by endorsement by presenting evidence satisfactory to the Board that the applicant has active licensure in another jurisdiction and has passed an examination before a similar, lawful, authorized, examining board in physical therapy in such other jurisdiction if their standards for licensure are as high as those maintained in Florida.

The Board's Order, filed on May 16, 2013, grants the Petition for Variance or Waiver. The Petitioner has demonstrated that the Petition for Variance and Waiver was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner has demonstrated that the purpose of the underlying statute has been met. Further, Petitioner has demonstrated that application of the rule would cause a substantial hardship and would violate the principles of fairness.
