    64B17-3.001Licensure as a Physical Therapist by Examination

    The Board of Physical Therapy Practice hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Juanita Coltman, filed on March 21, 2013. The Notice of Petition for Variance or Waiver was published in Volume 39, No. 67, of the April 5, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on May 3, 2013. The Petitioner sought a variance or waiver of Rule 64B17-3.001, F.A.C., in regards to the requirement that foreign graduates have received a determination that the credentials are equivalent to education required for licensure as a physical therapist in the United States as determined by the Foreign Credentialing Commission on Physical Therapy.

    The Board’s Order, filed on May 16, 2013, denies the Petition for Variance or Wavier. The Petitioner has failed to demonstrate that the purpose of the underlying statute has been met. The Petitioner has also failed to demonstrate a substantial hardship, and that application of the rules at issue would violate principles of fairness as defined by Section 120.542, F.S. and Chapter 28-104, F.A.C.
