    11B-35.009Exemption from Basic Recruit Training

    NOTICE IS HEREBY GIVEN that on June 26, 2017, the Florida Department of Law Enforcement, received a petition for a permanent waiver of Rule 11B-35.009(8), F.A.C., from Jason Cohen. Petitioner wishes to permanently waive that portion of the Rule that states: Individuals who have qualified for an exemption from a Commission-approved Basic Recruit Training Program, pursuant to this Rule section, shall become employed within four years from the beginning date of the required proficiency demonstration as entered on the Training Report from CJSTC-67. In support of his petition, Petitioner alleges that in July of 2012, Petitioner successfully completed an equivalency of training program and, in August of 2012, passed the State Officer Certification Examination (“SOCE”). Due to family health issues and family business responsibilities, Petitioner alleges that he was unable to apply for employment as a law enforcement officer until 2015, when he applied with the Lake Placid Police Department (“LPPD”) in Highlands County. The LPPD interviewed Petitioner and processed him for employment, but unfortunately, the LPPD did not have any open full-time law enforcement officer positions and thus could not hire Petitioner at that time. Petitioner’s four-year employment window expired in July of 2016 while he was waiting for a vacancy with the LPPD. Recently, a law enforcement officer position opened with the LPPD and the Chief of the LPPD desires to hire Petitioner to fill this position. Petitioner alleges that, should the waiver not be granted, Petitioner will suffer a substantial hardship as he would lose his employment offer with the LPPD and would have to retake the Basic Recruit Training Program at his own expense. Further, Petitioner asserts that the waiver, if granted, would satisfy the purpose of the underlying statutes as he has successfully completed a Basic Recruit Training Program and an Equivalency of Training Program and twice passed the SOCE, and his window for employment expired only one year ago.
