    The Florida Real Estate Commission hereby gives notice:

    Of the issuance of a Notice of Intent to Deny Petition for Variance or Waiver regarding Isaac Feldman, filed on March 9, 2017. The Notice of Petition for Variance and Waiver was published in Volume 43, No. 52, of the March 16, 2017 issue of the Florida Administrative Register. No comments were received on the Petition.

    The Commission considered the Petition at a duly-noticed telephonic public meeting held on June 6, 2017. The Petitioner requested a variance or waiver from Rules 61J2-3.009, 61J2-3.010 and 61J2-3.013, F.A.C., related to the expiration of his license on March 31, 2014 and his license becoming null and void on March 31, 2016. At its meeting, the Commission found that Section 475.183(4), F.S., requires an individual to apply for reinstatement within 6 months after the date that the license becomes void. In this case, Petitioner did not apply before his deadline of September 30, 2016. The Commission must abide by the statute and thus denied the petition.

    The Commission’s Order, filed on June 30, 2017, denies the Petition.
