    PURPOSE AND EFFECT: The Board proposes the rule amendment to delete unnecessary language and to add new language to modify the non-refundable application and renewal fees and to clarify the reinstatement application fee and renewal fee.

    SUMMARY: The rule amendment will delete unnecessary language and to add new language to modify the non-refundable application and renewal fees and to clarify the reinstatement application fee and renewal fee.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its meeting, the Commission, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    61G16-3.001 Schedule of Fees

    The following fees are prescribed by the Board:

    (1) through (4) No change.

    (5) Fees for Reinstatement of a Null and Void License:

    (a) Non r Refundable Application fee of $275.00,

    (b) Non Refundable Renewal fee of $50.00 for each biennium when timely renewal was missed, which contributed to the current null and void status, and

    (c) No change.

    (6) No change.

    (7) Fees for geologist-in-training registration (GIT):

    (a) The application fee for registration as a GIT shall be fifteen dollars ($15) and shall be non-refundable.

    (b) The examination fee for registration as a GIT shall be one hundred and fifty dollars ($150) and shall be refundable if the applicant is found to be ineligible to take the fundamentals portion of the examination.

    (c) The initial registration fee shall be twenty five dollars ($25) and shall be refundable if the applicant is found to be ineligible to be registered as a GIT.(8) Application for licensure by a registered geologist-in-training (GIT):

    (a) The application fee for licensure by examination shall be one hundred fifty dollars ($150) and shall be nonrefundable.

    (b) The examination fee for licensure by examination shall be one hundred dollars ($100), and shall be refundable if the applicant is found to be ineligible to take the practice portion of  the examination.

    (c) The initial license fee shall be one hundred dollars ($100).
