    62-610.475Edible Crops

    The Department of Environmental Protection hereby gives notice that on June 23, 2016, the Department of Environmental Protection entered a final order granting the City of Pompano Beach’s Petition for Variance (OGC Case No. 15-1690) from the requirements of subsection 62-610.475(4), F.A.C., which prohibits the use of an application method that allows for direct contact of reclaimed water on edible crops that will not to be cooked, peeled or thermally processed before consumption. The Petition for Variance (Petition) was received on December 23, 2015. Notice of receipt of this Petition was published in the Florida Administrative Register on January 19, 2016, Vol. 42, No. 11. No public comment was received. Petitioner sought the variance in order to avoid substantial economic hardship. Without the requested variance, the Petitioner would be required to continue to incur substantial costs to provide potable water for residential irrigation. The final order found that this economic hardship was unnecessary because the Petitioner could use reclaimed water to meet the demand for residential irrigation.
