    Miami Automotive Retail, Inc., d.b.a. Brickell Mazda for the establishment of Mazda

    Notice of Publication for the Establishment of a

    Franchised Motor Vehicle Dealer in a County of More

    than 300,000 Population

    Pursuant to Section 320.642, Florida Statutes, notice is given that Mazda Motor of America, Inc. d/b/a Mazda North American Operations ("MNAO") intends to allow the establishment of Miami Automotive Retail, Inc., d/b/a Brickell Mazda, as a motor vehicle dealership authorized to sell and service new Mazda motor vehicles. The initial proposed location of the facility for the sale of Mazda vehicles is 618 SW 8th Street, Miami (Miami-Dade County), Florida 33130. The initial proposed location for the service of Mazda vehicles is 665 SW 8th Street, Miami (Miami-Dade County), Florida 33130. If the proposed sales location is approved, NMNO contends that the establishment of the proposed service location will be exempt from protest in accordance with the provisions of Section 320.642(6)(b), Florida Statutes, because the proposed service location will be closer to the sales location of Miami Automotive Retail, Inc. d/b/a Brickell Mazda than to any other Mazda dealer and will be more than seven miles from any other Mazda dealer.

    If the initial proposed locations are approved, construction will be begin on a permanent facility to be located on real estate identified by the following addresses: 701 SW 8th Street, 705 SW 8th Street, 706 SW 7th Street, and 721 SW 8th Street, all located in Miami (Miami-Dade County), Florida 33130. These four parcels are contiguous. Upon completion of construction, the sales and service operations of the dealership will relocate from their initial locations to the permanent facility. The permanent facility is within two miles of both the proposed Mazda sales location at 618 SW 8th Street, Miami, Florida, and the proposed Mazda service location at 665 SW 8th Street, Miami, Florida. Therefore, MNAO contends the planned relocation of the Mazda sales operations of Miami Automotive Retail, Inc., d/b/a Brickell Mazda, will be exempt from the notice requirement, and protest rights of other Mazda dealers, pursuant to Section 320.642(5)(a)1, Florida Statues.

    Upon establishment of the dealership, Miami Automotive Retail, Inc. will do business as Brickell Mazda on or after October 30, 2013.

    The name and address of the dealer operators of Miami Automotive Retail, Inc., d/b/a Brickell Mazda, are Mario Murgado, 665 SW 8th Street, Miami, Florida 33130, and Rick Barraza, 665 SW 8th Street, Miami, Florida 33130. The name and address of the principal investor is: Mario Murgado, 665 SW 8th Street, Miami, Florida 33130.

    The notice indicates the intent to establish the dealership in a county of more than 300,000 population, according to the latest population estimates of the University of Florida, Bureau of Economic and Business Research.

    Certain dealerships of the same line-make may have standing, pursuant to Section 320.642, Florida Statutes, to file a petition or complaint protesting the application.

    Written petitions or complaints must be received by the Department of Highway Safety and Motor Vehicles within 30 days of the date of publication of this notice and must be submitted to: Nalini Vinayak, Administrator, Dealer License Section, Department of Highway Safety and Motor Vehicles, Room A-312, MS 65, Neil Kirkman Building, 2900 Apalachee Parkway, Tallahassee, Florida 32399-0635.

    A copy of such petition or complaint must also be sent by US Mail to: Blasé De Leo, Mazda North American Operations, 6601 Touchton Road East, Suite 3100, Jacksonville, Florida 32246.

    If no petitions or complaints are received within 30 days of the date of publication, a final order will be issued by the Department of Highway Safety and Motor Vehicles approving the establishment of the dealership, subject to the applicant's compliance with the provisions of Chapter 320, Florida Statutes.
