Final Order No. DEO-16-132
NOTICE IS HEREBY GIVEN that the Florida Department of Economic Opportunity issued Final Order No. DEO-16-132 on July 25, 2016, in response to an application submitted by Seminole Lake Golf and Country Club Estates Homeowners’ Association, Inc., for covenant revitalization under Chapter 720, Part III, Florida Statutes.
The Department’s Final Order denied the application for covenant revitalization after determining that it did not meet the statutory requirements as the Declaration of Covenants contains covenants that are more restrictive on the parcel owners than the covenants contained in the previous declaration, violating Section 720.404(3), Florida Statutes; the proposed Bylaws, which were amended after the extinguishment date, includes a restriction that was not contained in the previous governing documents and is more restrictive, violating Section 720.405(4)(d), Florida Statutes; and the Association did not provide a verified copy of the previous Articles of Incorporation and Bylaws for the Seminole Lake Golf and Country Club Estates Lake Annex and the Seminole Lake Golf and Country Club East Annex, violating Section 720.406(1)(b), Florida Statutes.
