PURPOSE AND EFFECT: The purpose of the rule amendment is to update the rule language.

SUMMARY: Continuing Education subject areas and means of satisfying the required hours.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members and the substance of the rule amendment, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary because the rule eliminates a required area of CE, which should result in an overall reduction in costs to licensees and businesses, and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

THE FULL TEXT OF THE PROPOSED RULE IS:

64B10-15.001 Continuing Education for Licensure Renewal.

(1) No change. 

(2) To satisfy the requirements of this rule, in each biennium a licensee shall have a minimum of forty (40) contact hours of continuing education credit. A contact hour shall consist of fifty (50) clock minutes. In any biennium:

(a) through (c) No change. 

(d) Beginning October 1, 2016, a licensee shall have a minimum of two (2) contact hours of continuing education on Florida laws and rules relating to the practice of Nursing Home Administration.

(d)(e) A licensee shall complete two (2) contact hours of continuing education relating to the prevention of medical errors.

(3) through (5) No change.

(6) Any licensee who acts as a preceptor for an Administrator-in-Training (AIT) and completes such preceptorship within any biennium shall be allowed ten (10) contact hours of continuing education credit for precepting one (1) AIT or fifteen (15) contact hours of continuing education credit for precepting two (2) AITs within that same that biennium.
