NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Larry Earl Franklin/Star Air Conditioning & Heating, LLC on April 28, 2014. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol. 40, No. 86, of the May 2, 2014, Florida Administrative Register. Petitioner asks the Board whether a “Class B air-conditioning contractor” as defined in Section 489.105(3)(g), Florida Statutes, can contract to perform, and perform, maintenance, service, and make repairs to the evaporator, compressor, condenser, coils, and other components of the refrigerant system of a swimming pool/spa heat pump. The Board’s Order, filed on August 5, 2014, states that: (1) The Petitioner is substantially affected, as required by Section 120.565, Florida Statutes, and (2) It is within the scope of the Petitioner’s license as a certified class b air-conditioning contractor to contract to perform, and perform, maintenance, service, and make repairs to the evaporator, compressor, condenser, coils, and other components of the refrigerant system of a swimming pool/spa heat pump.
