The Board of Optometry hereby gives notice that on August 3, 2016, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed by Austin Lifferth, O.D., on September 10, 2015, seeking a waiver or variance from subsection 64B13-4.001(2), F.A.C., with regard to the requirement that applicants for licensure must have passed all 4 parts of the licensure examination within the 7 year period immediately preceding application for licensure. The Notice was published in Volume 41, No. 203, of the Florida Administrative Register, on October 19, 2015. The Board, at its meeting held on May 13, 2016, voted to partially deny and partially grant the Petition for Waiver or Variance. Petitioner has shown that he is directly involved in Part II of the NBEO and may violate NBEO agreement by taking that portion of the examination and consequently, the petition for waiver and variance as it applies to Part II is Granted. Petitioner failed to show that waivers of Parts I and III of the examination would serve the purpose of the underlying statute and the statue would be achieved by other means and or that application of the above rule would cause a substantial hardship or violate the principles of fairness and is therefore Denied.
