    The Board of Optometry hereby gives notice that on August 3, 2016, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed by Akram Masood, on April 1, 2016, seeking a waiver or variance from subsection 64B13-4.001(2), F.A.C., with regard to the requirement that applicants for licensure must have achieved all three portions of Part III on the same test attempt score of 75% or better on all 4 parts of the licensure examination within the seven (7) year period immediately preceding application for licensure. The Notice was published in Volume 42, No. 66, of the Florida Administrative Register on April 5, 2016. The Board, at its meeting held on May 13, 2016, voted to deny the Petition for Waiver or Variance finding that the Petitioner did not demonstrate a substantial hardship; that application of the rule did not violate the principles of fairness; and that the purpose of the underlying statute was not met.
