Final Order No. DEO-16-138
NOTICE IS HEREBY GIVEN that the Florida Department of Economic Opportunity issued Final Order No. DEO-16-138 on August 2, 2016, in response to an application submitted by Patios on the Park Association, Inc., for covenant revitalization under Chapter 720, Part III, Florida Statutes.
The Department’s Final Order denied the application for covenant revitalization after determining that it did not meet the statutory requirements as the provisions contained in the Proposed Revived Declaration are more restrictive than the original covenants, violating Section 720.404(3), Florida Statutes, and the Association submitted the Proposed Revived Declaration more than 60 days after the date of approval by a majority of the affected parcel owners, violating Section 720.406(1), Florida Statutes.
