Board of Hearing Aid Specialists

The Board of Hearing Aid Specialists hereby gives notice:

Of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on May 31, 2017, by Sara Casey, Esquire, on behalf of Ellen Gartner. The Notice of Petition for Waiver or Variance was published in Volume 43, Number 105, of the June 5, 2017, Florida Administrative Register. The Petitioner was seeking a waiver or variance of Rule 64B4-6.004, Florida Administrative Code, entitled “Approval of Continuing Education Providers,” which provides the requirements for approval of continuing education providers. The Board considered the instant Petition at a duly-noticed public meeting held July 14, 2017, in Orlando, Florida.

The Board’s Order, filed on July 28, 2017, denied the petition finding that the rule that Petitioner requested a waiver or variance of was adopted by the Board of Clinical Social Work, Marriage and Family Therapy, and Mental Health Counseling. Therefore, the Board denied the petition for waiver or variance for lack of jurisdiction.
