NOTICE IS HEREBY GIVEN that the Florida Department of Agriculture and Consumer Services has declined to rule on the petition for declaratory statement filed by Paymaxx Pro, LLC and Leedom Capital Corp. on June 4, 2013. The following is a summary of the agency's declination of the petition:
The Department denied the petition on the basis that it lacked authority to issue the declaratory statement under Section 120.565, Florida Statutes as the Department does not administer Section 501.0117, Florida Statutes, and the declaratory statement sought would result in an impermissible statement of general policy and applicability.
