NOTICE IS HEREBY GIVEN that the Department of Financial Services, Division of Legal Services, has issued an order disposing of the petition for declaratory statement filed by Petitioner Choice Plus, LLC, on June 12, 2014. The following is a summary of the agency’s disposition of the petition:

On August 14, 2014, the Department of Financial Services, Division of Legal Services, issued an Order Denying Petition for Declaratory Statement, Case Number 155546-14-DS. The Order is regarding receipt of a Petition for Declaratory Statement Before the Department of Financial Services, filed on June 12, 2014, from Petitioner Choice Plus, LLC, seeking the Department’s opinion as to the applicability of subsection 717.1241(1), Florida Statutes, as to withdrawn claims. The Notice of Petition for Declaratory Statement was published in Vol. 40, No. 121, June 12, 2014, edition of the Florida Administrative Register. The Order Denying Petition for Declaratory Statement found that the Petition is defective, and that the Petition is Denied.
