NOTICE IS HEREBY GIVEN that the Department of State, Division of Corporations, has received the petition for declaratory statement from Household Finance and Mortgage Company, Inc. The petition seeks the agency’s opinion as to the applicability of Section 607.1501, Florida Statutes, as it applies to the petitioner.

Household Finance and Mortgage Company, Inc., (“HFMC”) is requesting that the Department of State, Division of Corporations, issue a Declaratory Statement that HFMC’s lending activities, including the hiring of Florida merchants for the sole purpose of facilitating HFMC’s loans is not considered “transacting business” within the state of Florida. HFMC’s argues that its activities are not considered business transactions that would require it to file an application for a certificate of authority under Section 607.1501, Florida Statutes.
