11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers
The Criminal Justice Standards and Training Commission hereby gives notice that on August 14, 2014, it issued an order granting a temporary 180 day waiver of paragraph 11B-27.002(4)(a), F.A.C., filed by Luz Borges, Esq. on behalf of Bradie S. Allen. Petitioner stated that Allen has successfully met all enumerated requirements for employment as a law enforcement officer and, but for the misconception by Allen and instructors of employing agencies that the mandatory four year period began at completion of training and examination rather than the beginning as stated in the rule, she would have been employed by a law enforcement agency. Petitioner states that application of the rule creates a substantial hardship and violates the principles of fairness.
On August 7, 2014, pursuant to notice, at a meeting held in Ponte Vedra, Florida the Commission found that Petitioner had demonstrated an economic, technological, legal, or other type of hardship resulting from an application of subsection 11B-27.002(4), F.A.C., that was particular to petitioner, significantly different from the way the rule affects other similarly situated persons and issued an order granting Petitioner's petition for a 180 day waiver of subsection 11B-27.002(4), F.A.C.
