    PURPOSE AND EFFECT: The purpose and effect of the proposed rule development is to add two new rules to Chapter 62-701, F.A.C. in order to 1) adopt the federal regulations in 40 CFR Part 257.50 through 257.107, “Standards for the Disposal of Coal Combustion Residuals in Landfills and Surface Impoundments” by reference into Chapter 62-701, F.A.C., through the fast track process in section 403.8055, F.S., and 2) adopt procedures in Rule 62-701.805, F.A.C., by which the Department of Environmental Protection will issue Coal Combustion Residuals Permits to facilities in Florida that are currently required to comply with the requirements in 40 CFR Part 257.50 through 257.107.

    SUBJECT AREA TO BE ADDRESSED: The subject matter to be addressed in this rulemaking includes adoption of the requirements in 40 CFR Part 257.50 through 257.107, “Standards for the Disposal of Coal Combustion Residuals in Landfills and Surface Impoundments” and any subsequent amendments or modifications that became effective prior to June 2019, into Chapter 62-701 F.A.C, and establishing the procedures by which Coal Combustion Residuals permits will be issued to facilities in Florida that are currently required to comply with the requirements in 40 CFR Part 257.50 through 257.107.
