NOTICE IS HEREBY GIVEN that the Department of Business and Professional Regulation, Division of Drugs, Devices and Cosmetics. has received a petition for declaratory statement from Sandy Reese, of Sevens Management Company 11 Inc. on July 29, 2016. The Petition does not state the statutory provision(s), rule(s) or order(s) on which the declaratory statement is sought. Presumably, the Petitioner is seeking the agency’s opinion as to the applicability of Chapter 499, Florida Statutes, and Rules 61N-1 and 61N-2, Florida Administrative Code, as they apply to the petitioner.

The Petition seeks a formal opinion from the Department as to whether the Petitioner needs a license to distribute non-prescription items (Insulin Syringes, Lancets, Glucometers and Test Strips) to pharmacies presumably in Florida. The Petition seeks a formal opinion from the Department as to the specific permitting requirements for Petitioner to engage in the business of distributing the non-prescription items listed above.
