The Department of Business & Professional Regulation, Division of Drugs, Devices, and Cosmetics hereby gives notice:
On July 17, 2018, Richard Difilippo (“Petitioner”), submitted a Petition for Emergency Variance/Waiver. The Petition seeks an emergency temporary variance or waiver from the requirements of Rule 61N-1.010, F.A.C. Notice of the petition was published in the July 31, 2018 issue of the Florida Administrative Register, Volume 44, Number 148.
Because Petitioner failed to demonstrate how the purpose of the underlying statute would be satisfied by Petitioner and failed to show a substantial hardship or that application of the rule to Petitioner violates principles of fairness, the Petition for emergency variance/waiver is denied.
