NOTICE IS HEREBY GIVEN that the Division of Alcoholic Beverages and Tobacco, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by BK Whopper Bar, LLC, DS-2012-062 on July 27, 2012. The following is a summary of the agency’s declination of the petition:

The Petitioner BK Whopper Bar, LLC a Florida liability company requests a Declaratory Statement as to whether Sections 561.22 and 561.42(1), F.S., prohibits BK Whopper Bar, LLC from holding a Florida Alcoholic Beverage License as a retail vendor pursuant in regards that the aforesaid business structure is permissible under Chapter 561, F.S.
