NOTICE IS HEREBY GIVEN that the Department of Business and Professional Regulation, Division of Alcoholic Beverages and Tobacco, has declined to rule on the petition for declaratory statement filed by Palm Bay International, Inc. on August 15, 2017. The following is a summary of the agency’s declination of the petition:

The Division hereby denies Petitioner Palm Bay International, Inc.'s Petition for Declaratory Statement as the Petitioner has not clearly stated their particular set of circumstances; the Petitioner is not a substantially affected person seeking Declaratory Statement regarding an agency rule as it applies to its particular set of circumstances; and the Petitioner asks the Division to evaluate a third party's behavior.
