    PURPOSE AND EFFECT: The rule amendment will delete unnecessary language and to add new language to update and clarify continuing education for licensure renewal.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board concluded that this rule change will not have any impact on licensees and their businesses or the businesses that employ them. The rule will not increase any fees, business costs, personnel costs, will not decrease profit opportunities, and will not require any specialized knowledge to comply. This change will not increase any direct or indirect regulatory costs. Hence, the Board determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

     

    64B10-15.001 Continuing Education for Licensure Renewal.

    (1) No change.

    (2) To satisfy the requirements of this rule, in each biennium a licensee shall have a minimum of forty (40) contact hours of continuing education credit. A contact hour shall consist of fifty (50) clock minutes. In any biennium:

    (a) A licensee shall have a minimum of twenty (20) contact hours of continuing education credits that include personal attendance at a live presentation or, as specified in paragraph (3) of this section, completion of classroom attended college course(s) taught with live lectures.

    (b) A licensee is allowed a maximum of twenty (20) contact hours of continuing education credits for any combination of web-based, video or audio-transmitted, home-study, or on-line interactive instruction programs or, as specified in paragraph (3) of this section, completion of on-line college course(s) that require the licensee to interact or communicate back and forth with the instructor during the presentation of the program.

    (c) A licensee is allowed a maximum of ten (10) contact hours home-study continuing education credits. Home-study education is independent study and includes pre-recorded programs that were previously classified as live or interactive under paragraphs (2)(a) and (b). A validation form shall be signed by the vendor and licensee verifying the subject covered and total viewing time. Home-study courses must not exceed five (5) contact hours per subject.

    (c)(d) No change.

    (3) Three Five contact hours of continuing education credit shall be granted for each college credit hour in the domains of practice specified in Rule 64B10-16.005, F.A.C. successfully completed during the biennium. The licensee shall identify the domain of practice and the delivery method of instruction applicable to the college course(s) submitted for continuing education credit. The college transcript shall be accepted as proof of attendance.

    (4) No change.

    (5) Any licensee who acts as a consultant to the Department of Health’s Testing Services Unit shall be allowed five (5) contact hours of continuing education credit for that biennium.

    (6) through (8) renumbered (5) through (7) No change.

    (8)(9) A licensee may obtain three (3) contact hours of continuing education credit in the area of risk management by attending one (1) full day of an in-person a Board meeting in compliance with the following:

    (a) through (c) No change.
