    PURPOSE AND EFFECT: The Department of Elder Affairs (“Department”) proposes the repeal of rules 58N-1.001, 58N-1.009, 58N-1.011, 58N-1.013, 58N-1.015, 58N-1.017 and 58N-1.019, Florida Administrative Code, because the legislature eliminated the sections of the Florida Statutes that provided for the establishment of long-term care community diversion pilot projects during the 2014 legislative session; therefore, the Department has determined that these rules are unnecessary.

    SUMMARY: The proposed rulemaking repeals rules 58N-1.001, 58N-1.009, 58N-1.011, 58N-1.013, 58N-1.015, 58N-1.017 and 58N-1.019, Florida Administrative Code, which establish criteria for the operation of long-term care community diversion pilot projects. The legislature eliminated the sections of the Florida Statutes that provided for the establishment of long-term care community diversion pilot projects during the 2014 legislative session; therefore, the Department has determined that these rules are unnecessary.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department conducted a review of the rules’ requirements and determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rules will not require ratification by the Legislature.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
