PURPOSE AND EFFECT: As grapefruit season does not match the season for oranges and as a result of the Department’s Inspector General's audit, in order to ensure a more accurate number is reported to the industry the Department is amending the rule to include a post estimate fruit pricing report for processed grapefruit.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: upon review of the proposed rule, the department has determined that the amendments will not exceed any one of the economic analysis criteria in a SERC as set forth in Section 120.541(2)(a), F.S.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

20-3.010 Fruit Pricing Verification Report

All licensed citrus fruit dealers engaged in the processing of processed citrus products or delivery of fruit for toll pack processing, shall file a post estimate fruit pricing verification report three times twice a season, as follows: once after that facility has completed the processing of early season oranges, once after that facility has completed the processing of late season oranges, and once after that facility has completed the processing of red/white grapefruit. after the end of each facility’s completing processing of early season fruit and late season fruit. Fruit pricing verification reports shall be submitted on forms provided by the Department of Citrus and incorporated by reference, https://www.flrules.org/Gateway/reference.asp?No=Ref-05495 into Rule 20-100.004, F.A.C., and shall be delivered by email to the location designated on the aforementioned forms. The reports are to be utilized by staff in preparing the Post-Estimate Price Report.
