The Department of Environmental Protection hereby gives notice:

An order was issued on August 16, 2023, granting Xerxes, formerly a ZCL Company acquired by Shawcor Pipe Protection, LLC’s Petition for a Variance. The Petition was received on January 13, 2023. Notice of receipt of the Petition was published in the Florida Administrative Register on January 20, 2023, Volume 49/13. The Petition requests a variance from paragraphs 62-6.013(2)(f) and 62-6.013(2)(i), F.A.C., which specify standards for onsite sewage treatment receptacles. No public comments were received. The Order, file number OGC #23-0062, grants the Petition for a Variance based on a showing that the Petitioner demonstrates the purpose of the underlying statute will be or has been achieved by other means and strict application of the rule would result in substantial hardship to Petitioner.
