    Hanania-Richardson Motorcars, LLC, d/b/a Coconut Point Honda for the establishment of Honda

    Notice of Publication for a New Point

    Franchise Motor Vehicle Dealer in a County of More

    than 300,000 Population

    Pursuant to Section 320.642, Florida Statutes, notice is given that American Honda Motor Co. Inc., intends to allow the establishment of Hanania-Richardson Motorcars, LLC, d/b/a Coconut Point Honda as a dealership for the sale and service of new Honda automobiles and light trucks (line-make HOND) at the specific location of the proposed dealership which is a parcel of land in Lee County, Florida, lying on the west side of U.S. 41 (Tamiami Trail S.R. 45), the northeast corner of which is 1140 feet south of the intersection of U.S. 41 and Williams Road, more particularly described as follows:

    A tract or parcel of land lying in Section 04, Township 47 South, Range 25 East, Lee County, Florida, being described as follows: Commence at the southwest corner of the northeast quarter of said Section 04, run North 88 degrees 25 minutes 47 seconds East (basis of bearings) along the East-West quarter section line for 118.32 feet to a point on the westerly right of way of U.S. 41 (Tamiami Trail, S.R. 45, 200 feet wide); thence run North 06 degrees 41 minutes 21 seconds West along said right of way line for 208.27 to a point of curve to the right having a radius of 2932.79 feet and a central angle of 10 degrees 13 minutes 21 seconds; thence run along the arc of said curve and right of way line for 523.26 feet to the Point of Beginning; thence run North 86 degrees 28 minutes 00 seconds West along a radial line to said curve for 500.00 feet to a point on a curve to the right having a radius of 3432.79 feet and a central angle of 01 degrees 19 minutes 17 seconds and said point being on a line common with a tract or parcel of land described in Official Record Book 1775 at Pages 2025 & 2026 of the Public Records of Lee County, Florida; thence run along the arc of said curve and along said common line for 79.17 feet to a point of tangent (as measured concentric to and lying 500.00 feet westerly to said right of way line; thence run North 04 degrees 51 minutes 17 seconds East along said common line for 811.36 feet; thence run South 85 degrees 08 minutes 43 seconds East for 500.00 feet to said westerly right of way line; thence run South 04 degrees 51 minutes 17 seconds West along said right of way line for 811.36 feet to a point of curve to the left having a radius of 2931.79 feet and a central angle of 01 degrees 19 minutes 17 seconds; thence run along the arc of said curve and right of way line for 67.64 feet to the Point of Beginning.

    Less and except: A tract or parcel of land lying in Section 04, Township 47 South, Range 25 East, Lee County, Florida, being described as follows: Commence at the southwest corner of the northeast quarter of Section 4; thence North 88 degrees 25 minutes 47 seconds East along the East-West quarter section line for 118.32 feet to an intersection with the westerly right of way of U.S. 41 (Tamiami Trail, S.R. 45, 200 feet wide); thence North 06 degrees 41 minutes 21 seconds West along said westerly right of way line for 208.27 feet to a point of curve to the right having a radius of 2932.79 feet and a central angle of 10 degrees 13 minutes 21 seconds; thence along the arc of said curve and said westerly right of way line for 523.26 feet to the Point of Beginning; thence North 86 degrees 28 minutes 00 seconds West leaving said westerly right of way line along a radial line to said curve for 284.32 feet; thence North 04 degrees 51 minutes 17 seconds East for 348.46 feet; thence South 85 degrees 08 minutes 43 seconds East for 283.46 feet to an intersection with said westerly right of way line; thence South 04 degrees 51 minutes 17 seconds West along said westerly right of way line for 274.27 feet to a point of curve to the left having a radius of 2932.79 feet and a central angle of 01 degrees 19 minutes 17 seconds; thence along the arc of said curve and said westerly right of way line for 67.64 feet to the Point of Beginning.

    American Honda intends to engage in business with Hanania-Richardson Motorcars, LLC, d/b/a Coconut Point Honda, on or after January 1, 2014.

    The name and address of the dealer operator(s) and principal investor(s) of Hanania-Richardson Motorcars, LLC, d/b/a Coconut Point Honda are dealer operator(s): Jack Y. Hanania, 7200 Blanding Boulevard, Jacksonville, Florida 32244 and Clark Richardson, 4801 Lemmon Ave, Dallas, Texas 75219; principal investor(s): Clark Richardson, 4801 Lemmon Ave, Dallas, Texas 75219 and Jack Y. Hanania, 7200 Blanding Boulevard, Jacksonville, Florida 32244, through his ownership interest in Hanania Automotive Corp. Five, whose address is 7220 Blanding Boulevard, Jacksonville, Florida 32244.

    The notice indicates intent to establish the new point location in a county of more than 300,000 population, according to the latest population estimates of the University of Florida, Bureau of Economic and Business Research.

    Certain dealerships of the same line-make may have standing, pursuant to Section 320.642, Florida Statutes, to file a petition or complaint protesting the application.

    Written petitions or complaints must be received by the Department of Highway Safety and Motor Vehicles within 30 days of the date of publication of this notice and must be submitted to: Nalini Vinayak, Administrator, Dealer License Section, Department of Highway Safety and Motor Vehicles, Room A-312, MS 65, Neil Kirkman Building, 2900 Apalachee Parkway, Tallahassee, Florida 32399-0635.

    A copy of such petition or complaint must also be sent by US Mail to: David Adair, American Honda Motor Co. Inc., 1919 Torrance Boulevard, Torrance, California 90501.

    If no petitions or complaints are received within 30 days of the date of publication, a final order will be issued by the Department of Highway Safety and Motor Vehicles approving the establishment of the dealership, subject to the applicant's compliance with the provisions of Chapter 320, Florida Statutes.
