NOTICE IS HEREBY GIVEN that the Florida Office of Financial Regulation has received the petition for declaratory statement from Robin EB, Inc. on May 7, 2018. The petition seeks the agency’s opinion as to the applicability of Chapter 560, Florida Statutes, as it applies to the petitioner.
The original petition sought a declaratory statement from the Office on whether the Petitioner's proposed business model (of providing online and real-time claim preauthorization and processing, assess and report health-plan utilization, and manage Participants’ out-of-pocket payments. To the extent that Robin does receive money for transmission, it is merely an incidental, but integral, component of the business in which Robin is primarily engaged—managing the back-office functions for healthcare insurance providers) falls within the Florida Money Transmitter Statute, Chapter 560, Florida Statutes. On May 11, 2018, the Office filed the Notice of receipt of Petition for Declaratory Statement in the Florida Administrative Register, Vol. 44, No. 93. On July 31, 2018, the Petition was withdrawn.
