11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

The Criminal Justice Standards and Training Commission hereby gives notice: on June 17, 2014, the Criminal Justice Standards and Training Commission received a petition for a temporary 180 day waiver of subsection 11B-27.002(4), F.A.C., from Kyle Durkin. Petitioner wishes to temporarily waive that portion of the rule that states within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment as an officer. Petitioner states that his State Officer Certification will expire on June 22, 2014. Petitioner states that he has been in the testing, screening and background evaluation process for a position with the Tampa International Airport Police Department since December 2013 however, that process has been slowed due to an internal agency evaluation. Petitioner also states that he is being considered for a position with the Pasco County Sheriff’s Office and the Tampa Police Department.

On August 7, 2014, pursuant to notice at a meeting held in Ponte Vedra, Florida, after careful consideration of the facts of this matter, the Commission found that Petitioner had demonstrated that a strict application of subsection 11B-27.002(4), F.A.C., would violate principles of fairness and have an impact on Petitioner that was particular to Petitioner and significantly different to from the way the rule affects other similarly situated persons in that Petitioner would be able to continue with the hiring processes of the Tampa International Airport Police Department and the Pasco County Sheriff’s Office. The Commission issued an order granting Petitioner’s petition for a temporary 180-day waiver of subsection 11B-27.002(4), F.A.C., issued on August 15, 2014, effective August 30, 2014.
