    NOTICE IS HEREBY GIVEN that Construction Industry Licensing Board has declined to rule on the petition for declaratory statement filed by American Council of Engineering Consultants of Florida on August 06, 2018. The following is a summary of the agency's declination of the petition:

    The Notice of Petition for Declaratory Statement was published in Volume 44, No. 109, of the June 5, 2018, Florida Administrative Register. The Construction Industry Licensing Board considered the Petition at its meeting held on July 13, 2018, in Sarasota, Florida. The Board’s Order, filed on August 6, 2018, declines to issue a declaratory statement in that the petition is vague and does not state a particular set of circumstances to which the statute in question would apply as required by Section 120.565, Fla. Stat. It is the Board’s opinion that subsections 489.113(2) and 489.115(1), Florida Statutes, are not ambiguous, and declines to clarify the statute.
